Different documents are filed for uncontested and contested divorce. A Virtual Paralegal will do an intake with the attorney's client to determine as follows:
Simplified Dissolution of Marriage (Uncontested): A Virtual Paralegal needs to determine if both parties are willing to dissolve the marriage amicably. Also, a Virtual Paralegal needs to verify that at least one of the parties lived in Florida for at least 6 months before filing for dissolution, there are no children of the marriage and the spouse is not pregnant, neither spouse is requesting alimony, division of assets and liabilities are agreed upon, and both spouses are willing to sign the petition and attend the final hearing. The Virtual Paralegal may prepare a Petition for Simplified Dissolution of Marriage if there are no children and the spouse is not pregnant.
Petition for Dissolution of Marriage with No Dependent or Minor Child(ren) or Property: Otherwise, if either spouse is seeking alimony, has questions concerning spouse's income, expenses, debts, or other matter before trial or settlement, and/or client wants to reserve his or her rights to appeal. We will confirm at least one spouse must have lived in Florida for at least 6 months before filing. We will submit pleadings to a process server for service on opposing spouse.
Petition for Dissolution of Marriage with Dependent or Minor Child(ren) (Uncontested or Contested): A Virtual Paralegal needs to determine if there are any children in the marriage or if a spouse is pregnant. A Virtual Paralegal may prepare a Petition for Dissolution of Marriage with Dependent or Minor Child(ren).
Petition for Dissolution of Marriage with No Dependent or Minor Child(ren) or Property (Uncontested): We will verify with the client if the opposing spouse is willing to sign the petition and will attend the hearing prior to using this petition.
